Welcome to BrisKites.

These Terms of Service apply when you use briskites.au or purchase products or services from BrisKites.

We've tried to keep them straightforward. By using our website or placing an order, you agree to these terms together with any other policies that apply to your purchase, including our Shipping & Delivery, Returns & Refunds, Warranty and Privacy policies.

Nothing in these terms excludes or limits any rights you have under the Australian Consumer Law (ACL) or any other rights that cannot legally be excluded.

Using Our Website

You may use the BrisKites website to browse products, obtain information and purchase products and services from us.

Please don't use the website:

  • for anything unlawful or fraudulent;

  • to interfere with the operation or security of the website;

  • to attempt to gain unauthorised access to our systems or customer information;

  • to transmit malicious software or harmful code; or

  • in a way that infringes another person's rights.

We may restrict access to the website where reasonably necessary to protect BrisKites, our customers or our systems.

Products & Product Information

We do our best to make sure product descriptions, specifications, photos, availability and other information on the website are accurate.

Many of the products we sell are supplied by specialist manufacturers, and manufacturers may occasionally update specifications, colours, packaging or components.

Product colours can also appear slightly different depending on your screen.

If a difference is significant or a product isn't as described, your rights under Australian Consumer Law still apply.

If you're unsure whether a product is suitable or compatible with your equipment, please contact us before ordering. We're happy to help.

Pricing

All prices displayed on our Australian website are in Australian dollars (AUD) unless stated otherwise.

Prices include GST where applicable.

We try to keep our pricing accurate, but occasionally a genuine website, data-entry or system error may occur.

If we identify a pricing error before an order has been accepted, we'll contact you and explain the situation. You won't be charged a higher price without agreeing to it.

Where Australian law requires a particular outcome for incorrectly displayed prices, we'll comply with those requirements.

Prices and promotions can change from time to time. Changes won't affect an order we've already accepted unless we agree otherwise with you or the law permits it.

Placing an Order

When you place an order, you'll normally receive an automatic order confirmation email.

That email confirms we've received your order. It doesn't necessarily mean we've accepted the order for fulfilment.

An order is accepted when we confirm it for fulfilment or dispatch it.

Before accepting an order, we may need to check:

  • product availability;

  • supplier availability;

  • payment;

  • delivery details;

  • suspected fraud or unusual transactions; or

  • whether we're able to legally and reasonably supply the product.

If we've taken payment but can't accept or fulfil the order, we'll refund the amount paid for the affected item or order.

We won't cancel an accepted order without a reasonable basis or where doing so would breach your rights under Australian Consumer Law.

Stock Availability

We sell a mix of products that are:

  • physically in stock at BrisKites;

  • available from Australian suppliers;

  • on backorder; or

  • available for pre-order.

Where a product isn't physically in our store, any supplier availability or estimated lead time is based on the information available to us at the time.

Supplier stock can sometimes sell out or change before our website updates.

If this happens, we'll contact you as soon as reasonably possible and let you know your options. Depending on the situation, you may choose to wait, select an alternative or receive a refund for the unavailable item.

Pre-Orders & Backorders

Products offered for pre-order or backorder may have an estimated arrival date or lead time.

These dates are estimates rather than guaranteed delivery dates, as manufacturing, international freight, distributors and other factors can cause delays outside our control.

If there's a significant change to the expected availability of your order, we'll let you know and discuss the available options.

Payment

Available payment methods are shown at checkout.

You agree to provide accurate payment, billing and contact information when placing an order.

Payments may be processed by third-party payment providers such as Shopify Payments, PayPal or other services offered at checkout.

Those providers may have their own terms and privacy policies.

We may hold or decline an order where there's a reasonable concern about fraud, unauthorised payment or payment verification.

Shipping & Delivery

Shipping costs, delivery estimates, oversized freight, international shipping and collection arrangements are covered in our Shipping & Delivery Policy.

Delivery dates provided by BrisKites, Australia Post or courier companies are generally estimates rather than guaranteed delivery dates.

If an order is significantly delayed or appears to be lost, contact us and we'll help investigate it with the carrier.

Returns, Refunds & Faulty Products

Our Returns & Refunds Policy explains our approach to:

  • change-of-mind returns;

  • faulty products;

  • damaged products;

  • repairs;

  • replacements; and

  • refunds.

Products purchased from BrisKites also come with consumer guarantees under Australian Consumer Law.

These rights can't be excluded by these Terms of Service, our Returns Policy or a manufacturer's warranty.

Warranties

Many products sold by BrisKites include a manufacturer's or Australian distributor's warranty.

These warranties are in addition to, not instead of, your Australian Consumer Law rights.

If you believe a product has a fault or you'd like to make a warranty claim, please use our Warranty Claim page so we can collect the information needed to assess the issue.

Promotions & Discount Codes

From time to time we may offer sales, discount codes, promotions or special offers.

Individual promotions may have their own terms, including start and finish dates, eligible products or minimum order amounts.

Unless we state otherwise, discount codes can't usually be combined with other discount codes.

We may correct or withdraw a promotion where there has been a genuine error, system problem or misuse, subject to Australian Consumer Law.

Product Reviews & Other Content

If you submit a product review or other content to BrisKites, please make sure it's based on your genuine experience and doesn't contain unlawful, abusive, defamatory, misleading or infringing material.

We may moderate or remove content where reasonably necessary for those reasons, but we don't remove genuine reviews simply because they're negative.

By submitting content for publication on our website, you give BrisKites permission to display and reproduce that content for purposes connected with our business and website.

Intellectual Property

Unless otherwise stated, the BrisKites website and the original content we create for it—including text, graphics, logos, guides, product-selection tools and website design—belong to BrisKites or are used with permission.

Manufacturer names, logos, images and other intellectual property remain the property of their respective owners.

You're welcome to use our website for normal personal shopping and reference purposes, but you may not reproduce substantial parts of our website for commercial use without permission.

Third-Party Links & Services

Our website may contain links to manufacturer websites, videos, social media, payment providers or other third-party services.

We don't control those external websites and aren't responsible for their content, availability or privacy practices.

A link doesn't necessarily mean BrisKites endorses everything published on that website.

This doesn't affect our responsibility for products or services you've purchased directly from BrisKites.

Kiteboarding, Foiling, Cycling & Other Action Sports

Many of the products we sell are designed for action sports where conditions, equipment setup, rider ability and correct use matter.

Always use equipment within your ability, follow manufacturer instructions and safety recommendations, and check your equipment before use.

Product information or general advice provided by BrisKites is intended to help customers choose and use equipment appropriately, but it doesn't replace proper instruction, good judgement or manufacturer safety information.

Nothing in this section limits any liability or consumer right that cannot legally be excluded.

Events Outside Our Control

Sometimes circumstances outside our reasonable control can affect our ability to operate or fulfil an order. These can include severe weather, transport disruptions, carrier delays, supplier delays, natural disasters, industrial action or major system outages.

We'll take reasonable steps to minimise disruption and keep affected customers informed.

Nothing in this section removes any rights you may have if products or services aren't supplied within the timeframe required by Australian Consumer Law.

Our Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under Australian Consumer Law or any other law where doing so would be unlawful.

To the extent the law allows liability to be limited, BrisKites will only limit liability to the extent reasonably permitted by that law.

We don't seek to exclude responsibility for loss or damage where the law says we're responsible for it.

Privacy

Our Privacy Policy explains how BrisKites collects, uses and handles personal information when you visit our website, contact us or place an order.

Changes to These Terms

We may update these Terms of Service from time to time as our business, website or legal requirements change.

Updated terms will be published on this page with a revised date.

Changes generally apply to future website use and future orders. We won't use a later change to unfairly alter the terms of an order we've already accepted.

If Part of These Terms Doesn't Apply

If any part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply where possible.

Australian Law

These Terms of Service are governed by the laws applicable in Queensland, Australia.

Nothing in this section prevents you from exercising any rights you have under Australian Consumer Law or other applicable laws.
